Jombone Inc. ("us", "we", "our", or “Jombone”) operates the www.jombone.com website as well as the Jombone app for iPhone and Android (hereinafter collectively referred to as the "Service").

This privacy policy (“Privacy Policy”) explains the ways in which we collect, use and disclose your Personal Information. “Personal Information” is information about an identifiable individual (for example, your name, residential address, telephone number, and email address).

By using the Service, registering an account on the Jombone App/website or otherwise providing us with your Personal Information, you consent to our collection, use and disclosure of your Personal Information in accordance with the terms of this Privacy Policy. This Privacy Policy should be read together with the Terms of Use (www.jombone.com/terms-of-use) . If you do not agree with or consent to this Privacy Policy or the Terms of Service, please do not use the Service or otherwise provide your Personal Information to us.

We will never sell or otherwise disclose to any third party any Personal Information that you provide to us without your permission, other than as described in this Policy, or unless we are required to do so by law.

We may modify, revise or update this Privacy Policy at any time by updating this posting. Each time you use the Service, the version of this Privacy Policy then posted will be applicable, so you should check this page each time you use the Service.

What Information Do We Collect?

Information You Provide

While using the Service to seek employment we will ask you to provide us with the following Personal Information:

    - Personal contact details such as name, title, full addresses, telephone numbers, and personal email addresses.
    - Profile Picture
    - Introductory Videos
    - Details regarding the type of employment sought, job preferences, and availability
    - Total Work Experience in Years
    - Work history and other relevant experience including information contained in a resume, CV, cover letter, or job application
    - Education History
    - Emergency Contact Name and Number
    - Two pieces of government issued photo identification required to start an active employment
    - Proof of Legal or Work Authorization Status required to start an active employment
    - Banking Deposit Information and Social Insurance Number (SIN) information to facilitate direct deposits and comply with applicable law, including a Void Cheque leaf
    - Jombone uses a third-party service provider who handles all credit card data such that Jombone only handles encrypted or tokenized credit card data.
    - For Companies which sign up on Jombone platform, Jombone collect business email, titles, phone number, mobile number and profile picture
    - Any other Personal Information you provide to us by way of a question or comment

Jombone may also receive Personal Information about you from third parties. This may include, for example, information received in connection with a background, employment, reference, and/or credit check. By using the Service, you consent to collection of such data about you.

While using the Service to find candidates for employment or independent contractors, we will ask you to provide us with certain information that may be Personal Information, including:
    - Email address
    - Company name (and/or first name and last name)
    - Phone number
    - Address, State, Province, ZIP/Postal code, City
    - Company history
    - Company locations
    - Key Contact Information
    - Industries Served by Company

When creating your account to use the Service, you will be asked to generate a username and password. Your username and password are personal to you and you should keep them safe and secure and not share them with anyone. We will collect any Personal Information you provide to us by way of a question, comment or otherwise. Also, if an employer uses Jombone’s Time and Attendance feature, we will collect a location and/or photograph of you each time you punch in or out of your job.

Information We Collect Using Technology:
Also, when you use the Service (including through your mobile device or computer), we collect technical information that is automatically recorded by the standard operation of our Internet servers. This information includes but is not limited to: the operating system you are using; IP addresses; browser type; the sections of the Service you visit; the Service pages read and images viewed; log information; time zone; unique application numbers or device identifiers and other diagnostic data.

This information may also be used for other purposes on an aggregate basis and in a de-identified form, including: (i) for Service and system administration; (ii) to improve the Service; (iii) to conduct internal reviews of the number of users to the Service; (iv) to help us better understand how users interact with the Service; (v) to respond to specific requests from users; and (vi) to protect the security or integrity of the Service when necessary.

Cookies
When you use the Service, we may deploy a “cookie” to your browser or place it on the hard drive of your computer, which allows the Service to remember who you are. Cookies provide additional functionality to digital platforms to better match users’ interests and preferences and enhance security. With most Internet browsers, you can erase cookies, block the creation of cookies, or receive a warning before a cookie is stored, although doing so may affect your use of the Service and your ability to access certain features of the Service. Please refer to your browser instructions or the help section of your browser to learn more about these functions.

Web Beacons
Our Service may also use web beacons. When you access certain pages of the Service, a non-identifiable notice of that visit is generated. These technologies usually work in conjunction with cookies. If you do not want your cookie information to be associated with your visits to these pages, you can set your browser to turn off cookies. If you turn off cookies, web beacons will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.

Mobile Devices
When you download and install the App onto your mobile device, we assign a random number to your App installation. This number cannot be used to identify you personally, and we cannot identify you personally unless you choose to become a registered user of the App. We use this random number in a manner similar to our use of cookies, as described above. Unlike cookies, however, the random number is assigned to your installation of the App itself and not to a browser, because the App does not work through your browser. Therefore the random number cannot be removed through the modification of any settings. If you do not want us to use the random number for those same purposes for which we use cookies, please do not use our mobile device App. Because some of the content on our mobile device App directs your mobile device to our website, you will be exposed to the cookies that we use and to third party cookies that may be contained in advertisements that we do not control. We will be unable to delete any of these cookies with your mobile device. Therefore, if you do not want to be exposed to cookies when you use your mobile device you should not use our mobile device App and you should set your mobile device to reject cookies when you use our mobile optimized sites. Our use of cookies and web beacons on our mobile optimized sites are similar to our use of cookies and web beacons on our websites. Your choice to reject cookies is available on our mobile optimized site. If you have questions about how to reject cookies on your specific device please check with the device manufacturer.

For What Purposes Do We Collect, Use and Disclose Personal Information?

We collect, use and disclose Personal Information:
    - To provide the Service, including by providing the Personal Information you provide to us to prospective employers or contractors, as applicable, in order to manage the hiring process and the ongoing employment or contractor relationship, including by allowing employees, employers and contractors to contact each other directly via email or phone, or through the “Messages” feature provided with the Service
    - To ensure candidates for employment qualify to use the Service, including by performing criminal and background checks, credit checks, and SIN verification
    - To generate a candidate’s employability rating, also known as a candidate’s “JScore”, which will be shared with prospective employers or contractors
    - To implement Jombone’s Time and Attendance feature, with Jombone and your employer or contractor using some of your Personal Information each time you punch in and out of your job, thereby monitoring your time and attendance on the job
    - To analyze your employment situation in the context of other data we source
    - To notify you about changes to our Service
    - To provide user care and support
    - To monitor the usage of and improve the Service
    - To detect, prevent and address technical issues

When Personal Information that has been collected is to be used for a purpose that we have not previously identified, we will communicate the new purpose before using it for that purpose, unless the new purpose is required or permitted by law.

We may send you suggestions about your use of the Service or amendments to our Terms of Use or Privacy Policy as well as notification emails and text messages as part of the Service. We may also send you promotional offers, newsletters or information about our existing Service or new services, in accordance with applicable law (“Promotional Information”).

Other than as described above, or required or allowed by law (for example, in response to a court order or subpoena, or to comply with local or federal regulations), your Personal Information will not be used for any other purpose without your consent.

Disclosure Of Personal Information
The nature of the Service is such that the Personal Information you provide may be disclosed to prospective employers or contractors. This includes some or all of the Personal Information you provide to us as well as your JScore, which is generated by Jombone and is based on the Personal Information you provide. By using the Service, you consent to the collection, use and disclosure of your Personal Information as described above.

In addition to the Personal Information you provide which may be disclosed to prospective employers or contractors, Jombone may from time to time disclose Personal Information about users to third parties who provide services to Jombone (“Third Party Service Providers”). Such services may include hosting and infrastructure services, banking services, criminal and background checks, credit checks, payroll distribution and SIN verification provided by government agencies. We will limit this disclosure to only the Personal Information that is reasonably necessary for the purpose or service for which the Third Party Service Provider is engaged. We will use contractual and other means to provide a comparable level of protection while the information is being processed by these Third Party Service Providers, including limiting such providers to using your Personal Information solely to provide Jombone with the specific service for which they were engaged, and for no other purpose.

Jombone may also disclose certain Personal Information you provide in order to respond to legal requirements, enforce our policies, respond to claims that content violates the rights of others, or protect anyone’s rights, property, or safety. Such information will be disclosed in accordance with applicable laws and regulations. We may also share your Personal Information with analytics providers that assist us to improve and optimize the Service. We may also share your Personal Information with law enforcement, national security or regulatory agencies or other governmental officials, as required or permitted by law, such as in response to a court order or a verified request relating to a criminal investigation or alleged illegal activity. We may share or transfer your Personal Information where reasonably required in the context of a sale, merger or amalgamation of all or part of our business or the insurance or securitization of our assets. In any such case, the recipient parties will be contractually required to keep the information confidential and use it only for the purposes of the transaction, or proposed transaction. In the event a business transaction is concluded, assignees or successors of Jombone or our business or assets may use and disclose Personal Information only for the purposes as set out this Privacy Policy, unless further consent is obtained.

In addition, aggregated, non-personally identifiable information may be provided to other parties for marketing or advertising purposes.
Your Personal Information may be stored or processed outside Canada where it may be accessed by governmental and law enforcement authorities without notice to you.

Safeguarding Your Information
We take all reasonable measures designed to safeguard your Personal Information against unauthorized access, use, disclosure, copying or modification. Such measures, which may necessarily evolve over time as the availability and effectiveness of methods vary, include physical, organizational and technological safeguards, such as:

    - restricting access to our systems, accounts and electronic databases or other electronic formats that may contain Personal Information through password protection and internal security policies; and
    - implementing technical security measures such as firewall technology, anti-malware screening and data encryption technology. These security measures specifically include, for example, encrypted password protection, SSL certificates, network port blocking, ReCaptcha and two-factor authentication.

While Jombone uses data encryption technology when interfacing with our users, Third Party Service Providers and other partners, users should be aware that there is a residual risk in transmitting any data electronically. Despite our efforts, no security measures are perfect or impenetrable and no method of data transmission can be guaranteed against any interception or other type of misuse. This risk is inherent in all Internet dealings.

Retention and Disposal of Personal Information
We will keep Personal Information only for as long as it remains necessary for the purposes for which it was collected, or as required by law. We use secure means of disposing of Personal Information.

Correcting Your Personal Information
Since we generally rely on you to inform us if there have been any changes to the Personal Information that we have collected about you, please let us know if any of this information has changed by updating your profile. We will not routinely update this information, unless it is necessary for us to do so to fulfill the purposes for which we collected the Personal Information.

Access to Personal Information
If required by applicable privacy law in your jurisdiction, we will, on request, provide you with reasonable opportunity to access the Personal Information about you that we retain, and, as appropriate, have it corrected or updated. All such requests must be received in writing. We will make the information available within 30 days or provide written notice of extension where additional time is required to fulfill the request. Please note that your right to access your Personal Information may be limited by applicable privacy laws. In order to verify your identity, we may also request that you provide certain Personal Information to us to match against our records.

Children's Privacy
Please do not use our Service if you are under the age of 18.

Changes to This Privacy Policy
We may update our Privacy Policy from time to time as our business evolves, in response to legal developments, as new technologies become available or as we introduce new features, products, or services. When we make changes to this Privacy Policy we will revise the “Last Updated” date at the top of the policy. Changes to this Privacy Policy are effective when they are posted on this page. You should check back here periodically to find out if any changes have been made to this Privacy Policy.

If you do not consent to any change to the Privacy Policy, you may close your Account and refrain from using the Services. Continuing to use our Services after we post or communicate a change signifies that you consent to the revised terms of the Privacy Policy.
